General terms and conditions of trade


(Apply to natural and legal persons from Slovakia or abroad buying products or using services for purposes other than subsequent sale to the end consumer or directly for sale to the end consumer.) Slovak customers can use the e-shop for buying products of the company Yasuhara.


1. Basic provisions

The term consumer refers to a natural or legal person buying products or using services for purposes other than subsequent sale to the end consumer (retail).


The term seller refers to a natural or legal person buying products or using services for purposes of subsequent sale to the end consumer (wholesale).


The term customer refers to consumer and seller.


The term supplier refers to the company MakroFoto s r.o.


The term shop refers to the e-shop operated by the supplier and represented by a set of web sites and applications of the e-shop.

3. Information about products, prices

All prices on the website are subject to contract, incl. VAT and they are stated next to the product and in the shopping cart. The company MakroFoto s.r.o. is VAT registered.


Prices for sellers (wholesale prices) are set individually after agreement with the seller and his registration into the system of product sellers of the company Yasuhara.


MakroFoto s.r.o. provides you with the main characteristic of the products and services, further information according to the type of product and manufacturer identification on the website next to the product.

Warranty shall be governed by the Civil Code No. 40/1964 Coll. as amended. Warranty period is 24 months after date of delivery to the customer.  Because of that please keep the product delivery (payment) record.


The warranty period shall be extended for the period during which the customer could not use the product due to warranty repairs of the product. In the case of product replacement the buyer shall get a record specifying the replaced product and any other new complaints shall be applied based on the original delivery note and protocol of the repair. The warranty period for exchange goods begins to run again from the date of receipt new products. The warranty claim expires in case of damage by improper use or other non-standard manipulation.


4. Terms of delivery, orders

Delivery time  

The primary priority for the e-shop is a quick delivery of products to the customer. Delivery time stated on the websites of means:

  • in stock – products are shipped within one day, because they are available in stock
  • 14 days – we order the products from abroad (from overseas) and they will be sent within two weeks from the order  
  • sold out – products are sold out at the moment

Unless we are able to deliver the ordered products by the agreed date we will inform you as soon as possible after the receipt of the order by phone or e-mail.


Method of transport


You can order products by selecting products into your shopping cart, stating the method of transport and payment and submitting the order. After sending the order you receive a copy of your order by e-mail with confirmation and information related to its implementation. In case the product is not available in stock you will be informed immediately.


Delivery by EMS (Express Mail Service), SPS (Slovak UPS) and by a contract delivery service.


We send the products to the customer by EMS, SPS and delivery service. You can choose the most appropriate method of transport and payment for the products. We guarantee a safe shopping in all cases. All prices are for 1 order up to 1 kg, when ordering products over 1 kg current prices for transport will be displayed.

Receipt of products from the transporter

The customer is obliged to inspect and receive the order only in case it is not damaged. If the delivered consignment is damaged, you shall not sign the delivery note provided by the transporter until you inspect the product in the package in the presence of the transporter. In case of a damaged product you shall draw up a complaint with the transporter and inform the supplier immediately. The customer is subsequently obliged to cooperate when dealing with the complaint. We will deliver new products within 3 days if they are in stock.


If the consignment was not damaged when received but despite that the product is damaged after unwrapping (internal deformation, crack caused by excessive shaking), please inform immediately (no later than on the next workday) the transporter. The complaint will not be considered later.

5. Payment for products 

There are twol ways to pay for your shopping on the website After our confirmation of the order you will be provided with available payment gateway. You can find payment gateway after receipt of confirming e-mail on your account, section My orders. Thank to development of the Internet banking you can pay your order immediately after its submitting.

Payment with PayPal.

You can use the service PayPal for safe payment for products and services on the Internet. At present the Paypal account is available for users from Slovakia and abroad. That means a standard Paypal account. You pay for the products easily through payment gateway PayPal on our website. Data about your account will be disclosed only to the company PayPal so you do not have to worry about misuse of your data. The company MakroFoto s.r.o. shall not charge any other extra fees related to implementation of the order (e.g.: packing and handling charges).

6. Other trading terms and conditions of contract

Receipt of tax document and certificate of warranty by the customer.


The consignment always contains a tax document (invoice) which also serves as a certificate of warranty in case of complaint or warranty repair in an authorised service. Therefore it is necessary for you to keep the tax document about purchase of the product at least for 24 months from receipt of the product.


Further communication with customers after dispatch of the order.


The customer will be informed about dispatch of the order per e-mail. At the same time the customer shall receive information about order dispatch per SMS together with the consignment number.


Information about the right of withdrawal of the contract.


The buyer if he is also consumer is mandated to withdraw from the contract of sale within 14 days after receipt of the product without giving any reason in compliance with the provisions § 12 (1) Act No. 108/2000 Legal Code about Consumer Protection in Doorstep Selling and Distance Selling as amended (hereinafter "The Consumer Protection (Distance Selling) Regulation").


The withdrawal from the contract must be in writing to the e-mail address The withdrawal from the contract of sale must contain under the foregoing provision the identification of the buyer, number and date of the order, exact specification of the product, way in which the seller is obliged to return the received payment mainly the account number and/or the address. Together with the withdrawal from the contract of sale the buyer is obliged to deliver the product with accessories to the seller inclusive documentation, instructions, certificate of warranty, payment record etc. in original packaging as an insured item.


If the buyer withdraws from the contract and delivers the unused product to the seller in original sealed packaging and the product is not damaged or incomplete, the seller shall repay the payed purchase price for the product or its part, which is stated in the binding acceptance of the order to the buyer within 15 days from the delivery of the withdrawal from the contract of sale and delivery of the product to the seller by bank transfer to account of the buyer.


In case the buyer withdraws from the contract and delivers already used, damaged or incomplete product to the seller, the seller repays the payed purchase price for the product, which is stated in the binding acceptance of the order to the buyer reduced in compliance with the provisions § 457 Civil Code by the amount of wear in the amount of 1% of the total price of the product for every day of its usage and amount for repair and putting the product in original condition within 14 days from the delivery of the withdrawal from the contract of sale and delivery of the product to the seller by bank transfer to account of the buyer.


If the withdrawal from the contract is valid the seller shall repay the purchase price to the buyer inclusive costs incurred when ordering the product, if the buyer presents together with the product also records about costs incurred in respect to product ordering. The buyer shall not share costs for return of the product if the product does not meet quality requirements and is defective at the same time. A product of the same or similar characteristic which is stated in the offered products at the website of the seller is considered to be a product meeting quality requirements.


Costs incurred when ordering the product are costs for the order completion, mainly the price for the phone call made for a proposal of the buyer for concluding the contract of sale or the price for Internet connection of the buyer to the website of the seller during which the buyer filled and submitted the form for ordering the product at the website or wrote and sent an e-mail with order of the product for the duration of 30 minutes.


If the buyer does not fulfil any of his obligation stated in this general terms and conditions the withdrawal from the contract is not valid and effective and the seller is not obliged to return the purchase price to the buyer and he is entitled to reimbursement related to returning of the product to the buyer.


The right to withdraw from the contract is not applicable to books, magazines, software and DVD which were unwrapped by the customer. The withdrawal from the contract is also not applicable to products intended only for one customer or products which can not be returned because of their properties.

The right to withdraw from the contract in compliance with the provisions § 12 (1) Act No. 108/2000 Legal Code about Consumer Protection in Doorstep Selling and Distance Selling as amended (hereinafter "The Consumer Protection (Distance Selling) Regulation") is not applicable to sellers.


Methods to cancel orders by the customer.


The buyer is entitled to withdraw from the confirmed order without giving any reason anytime before its expedition by e-mail, SMS or phone without penalty. If the buyer paid for the product in advance the seller is obliged to repay him the purchase price by bank transfer to bank account stated by the buyer within 3 days after delivery of the withdrawal from the order.


Procedure in case the supplier is not able to deliver the product and supply the complete order.   

The supplier is entitled to cancel the order if the product is sold out or unavailable and he is not able to deliver the product to the customer within the period specified in these terms and conditions or for a price stated at the e-shop unless otherwise agreed with the customer even when all effort which can be required fairly from him was made. The customer shall be demonstrably informed about cancellation of the order by phone or e-mail and in case of paid purchase price the financial means shall be returned to him as soon as possible, however, no later than within the statutory period of 15 days.


7. Order processing

The customer can have a look at the list of products (with prices) selected in his ‘‘shopping cart’’ before he submits the order. In this or in the next step of the order process he is also acquainted with the method of transport and payment with possibility of selecting and changing these data. He gets information about delivery fees or other fees charged for the purchase.


The customer is acquainted with the total price of the order before order approval/sending/confirmation, i.e. the price for the product and all other fees. Prices at the e-shop are inclusive of VAT. The company MakroFoto s.r.o. is VAT registered.


The order is confirmed by two successive operations, first one for selection of the product (saving to the shopping cart), second one for final order confirmation.


Order confirmation by the supplier.


After receiving of the order the supplier shall cofirm its receipt to the customer by e-mail. After checking availability of ordered products at the distributor or in stock the supplier confirmes the binding supply of the product.

The customer receives business data within the confirmation e-mail:

- identification of the supplier,

- identification of the customer,

- identification number of the order,

- date and time of the order,

- name of the product, ordered quantity, unit price and total price of the product,

- method of transport and payment,

- price for transportation,

- total price of the order,

- information about term of delivery within which the product will be ready for transport or sending.


8. Warranty and complaint conditions



The warranty period is 24 months unless otherwise stated for the product and starts on the day of receipt of the product by the customer. Given warranty does not apply to defects and damage caused by non-standard manipulation, unsuitable use or improper product care.

Warranty service is provided by the e-shop operator. On demand we provide information about service centers by phone or e-mail.


Resolving complaint.

In the event a defect occurs on the purchased product the customer is entitled to exercise the right of the liability for product defects – set up a complaint. The buyer is entitled to apply warranty to the seller only if the product shows defects caused by the manufacturer, supplier or seller, if the warranty applies to the product and it was purchased from the seller. The buyer has no right to apply warranty for defects which he was warned of at the time of making the contract or about which he must have known with regard to the circumstances when making the contract.


The warranty does not apply to damage caused by natural or excessive mechanical wear, contamination of the product or its parts due to neglect of maintenance, product use under conditions which do not meet the requirements with regard to temperature, dustiness, humidity, chemical and mechanical impacts of the environmnent in which the product is commonly used. The warranty does not apply to damage caused due to natural disaster, violent damage and weather conditions. The entitlement to exercise the warranty expires if evident defects are not announced during receipt of the product.


The seller is obliged to resolve the complaint and terminate the complaint resolution process in one of the following ways:

a) handing in a repaired product,

b) replacement of the product,

c) repay of the purchase price of the product,

d) payment of respective discount from the price of the product,

e) reasoned rejection of the complaint.


Complaints protocol, place for delivery of claimed product.

If you want to reclaim any product, please, contact us in advance. Send the reclaimed product (preferably after agreement with us) to the address, Karloveská 32, 842 02 Bratislava. We recommend you to insure the product and send it in a package as a registered letter. Do not send the product cash on delivery. Enclose a copy of the tax document into the package which was sent to you with the product and a copy of the receipt from the supplier. Also fill in the form of complaint and send it to us. We will confirm the receipt of the complaint within 24 hours.


After receiving of the reclaimed product we will contact you immediately by e-mail or phone and we will agree on a quick solution of your problem. The supplier will decide on the complaint immediately, in complex cases within 3 days. In reasoned cases mainly if the situation calls for difficult assessment of the condition of the product within 30 days from the day of application of the complaint.


After expiration of this period the buyer is entitled to withdraw from the contract or he is entitled to have the product replaced for a new product. The buyer shall be informed about the outcome of the complaint immediately after termination of the complaint resolution process by phone and the complaint protocol will be delivered per e-mail or registered mail. You can keep yourself informed about the complaint resolution process by phone on workdays from 8.00 a.m. to 17.00 p.m. or by e-mail.

Subsequently you will be asked by phone, e-mail or registered letter to take over the repaired product or we will directly deliver the product together with complaint protocol as a registered letter.

During complaint application the customer is obliged to deliver the claimed product in original packaging inclusive manuals, installation media, copy of delivery record and invoice or receipt. Repair within warranty period is free of charge.


9. Protection of customer personal data

MakroFoto s.r.o. considers the protection of your privacy as one of its most important obligations. We have to know basic information about you so that we could provide all services. Some of these information have the character of personal data within the meaning of the Act No. č. 428/2002 Legal Code about Personal Data Protection. This Act is authoritative for us what concerns the protection of your privacy.


Following information about you is necessary for yourregistration and shopping at the e-shop

  • first and last name, address inclusive country (or invoice address),
  • your e-mail address (serves for your identification in the system and for our communication with you),
  • optional other addresses (if you want your consignment to be delivered to other address than the invoice address)
  • optional phone number (for a faster contact with you),
  • if you purchase as a company/self-employed person, extra data: commercial name, ID number, VAT number, bank connection (for issuing the invoice and proper accounting).

These data are stored in a secured databasis on a secured server so that you do not have to fill them in everytime. This kind of data is also needed for our accounting and billing system. You can change your data and other settings anytime per e-mail or after signing into the section Sign In. If you want to delete your registration please ask per e-mail. Your account will be canceled.


We do not disclose your data, give access to them or provide them to any other subjects except to organizations which cooperation is inevitable for a proper execution of your order.


With use of the e-shop the customer agrees with collecting and using of data about him and his shopping within the meaning of the Act No. 428/2002 Legal Code about Personal Data Protection in Information Systems. The customer authorises the supplier for an indefinite period and is entitled to withdraw the consent at any time in writing. The consent expires within the period of 1 month after the delivery of the withdrawal of the consent to the supplier.
